�� ; December 5, 1983 �'O : �'ROM : Planning Commission Memb�rs Ron Moorse�, Administrative Assistant 0 SUBJECT: Margolis Brothers Company Compliance With Special Use Permit Conditions At the November 2, 1983 Planning Commission meeting, + he Commissi�n requested i.n- foi^mation concernir�g Margolis Brothers Company's compiiance with the conditions of its existing special use permit. Gordon Beseth, Chief Code Enforcement Officer, and T have inspected the site to determine compliance with the existi.ng special us�=_ perr,v.t conditions, and have found several areas of noncompliance. T►�.e c:onditions attached to the special use permit are as follows: 1) Th�;t the City of Roseville be permitted unlimited access t� the City park loc,�ted adjacent to thp Margolis property across the northerly 460' of the Marcrolxs property. 2) That a chain link fence be constructed around Lhe above-ground growing area immediately, and that the in-ground g.rowing area be :�enced by September 1, 1976. 3) That no retail sales be permi.tted. 4) That the southwest coi-ner of the equipment storage area be located 60 feet north of the south propPrty line and 60 feet east of the west property line, and that the total equipment storage area be limi.ted to an area 180 feet by 80 feet, and that the equipment storage area be screened from view on the south and east, with permanent plantings along �altier. Conditions 1 an.d 3 have been complied with. Condition 2 has been complied with, except that a section of the fance on the south- easterly corner of the site is in disrepair. The �c�uipment storage area is larger than is specified in condition 4. The existing equiprnent s��rage are a is app roximately 180 fe�t by 130 feet. It appears the existing trees at the south end of Galtier provide adequate screening of the equipment storaq� area during �Yie summer months. - In addition to �:he conditions placed on the �pproval of the special use permit Margolis Brothers Company is also responsible for using the site in accordancel with the plan submitted with the application for special use permit. The actua]. screening and the actual l�cation of structures and mate rials on the site do not comply with the plan in several instances.
