This property consisting of 11.37 acres, owned by Northwest Unit Investment <br />Company (known in previous proceedings as Mary Offenson's Northwest Tennis <br />Clubs) was originally zoned Commercial in 1952 when it was acquired by <br />Allied Stores (owners of Donaldson's Department Stores in this area). In <br />1959 when the City was rezoned the land, which then included the developed <br />land to the southwest and the Rosedale Shopping Center site was zoned SC, <br />Shopping Center District. The original zoning in 1952 left the easterly <br />portion of this site in a "Class A" residential zone (single family). When <br />the rezoning was done in 1959, the easterly 165 feet was left in the new <br />R-1 (Single Family) Zone. This generally conformed to the original area <br />remaining single family. The 165 feet was left so that it would have been <br />possible to develop residential lots on the west side of Fry Street. 30 <br />feet would have been dedicated for the westerly half of Fry Street (not only <br />30 feet in width), leaving 135 feet for lot depth. 135 feet times 85 feet <br />of frontage equals the minimum lot requirement of 11,000 square feet. <br />2. In August of 1976, the Planning Commission and Council approved a develop- <br />ment plan for the site submitted by Northwest Tennis Clubs for a retail <br />and athletic club structure which placed the structure within 100 feet of <br />the east property line. That structure was placed 50 feet from the north <br />property line. Thus, the easterly 65 feet of that building was in a <br />residential zone. That was allowable inasmuch as an athletic club is a <br />special use in the R-1 District. <br />3. The current plan is based on the same setback criteria as was established <br />in the approval of the athletic club and retail structure approved in 1976. <br />This building is also placed 100 feet from the easterly property line, but <br />is located 100 feet fromthe north property (50 feet greater than the <br />previously approved plan). Because portions of the building on the easterly <br />65 feet of the structure are utilized for theatres and retail uses, in this <br />case, it will be necessary to rezone the easterly 65 feet from R-1 to <br />Shopping Center District. The remaining easterly 100 feet of this site <br />is proposed to remain in the R-1 District with the reduction from the required <br />setback to 0 feet. <br />
