the Architect for any damage resulting from any such <br />errors, inconsistencies or omissions in the Contract Docu- <br />ments. The Contractor shall perform no portion of the <br />Work at any time without Contract Documents or, where <br />required, approved Shop Drawings, Product Data or <br />Samples for such portion of the Work. <br />4.3 SUPERVISION AND CONSTRUCTION PROCEDURES <br />4.3.1 The Contractor shall supervise and direct the Work, <br />using his best skill and attention. He shall be solely re- <br />sponsible for all construction means, methods, tech- <br />niques, sequences and procedures and for coordinating <br />all portions of the Work under the Contract. <br />4.3.2 The Contractor shall be responsible to the Owner <br />for the acts and omissions of his employees, Subcontrac- <br />tors and their agents and employees, and other persons <br />performing any of the Work under a contract with the <br />Contractor. <br />4.3.3 The Contractor shall not be relieved from his obli- <br />gations to perform the Work in accordance with the <br />Contract Documents either by the activities or duties of <br />the Architect in his administration of the Contract, or by <br />inspections, tests or approvals required or performed un- <br />der Paragraph 7.7 by persons other than the Contractor, <br />+.4 LABOR AND MATERIALS <br />4.4.1 Unless otherwise provided in the Contract Docu- <br />ments, the Contractor shall provide and pay for all labor, <br />materials, equipment, tools. construction equipment and <br />machlner, , water, hea,, utilities, transportation, and ether <br />famtities and services necessary for the proper execution <br />and completion of the `fork, whether temporary, or per. <br />manent and whether or not incorporated or to be incor- <br />Porated in the Work. <br />4.4.2 The Contractor shall at all times enforce, strict dis- <br />cipline and good order among his employees and shall not <br />employ on the Work any unfit person or anyone not <br />skilled In the task assigned to him. <br />4.S WARRANTY <br />4.5.1 The Contractor wjtrants to the Owner and the <br />,Architect that all materials and equipment furnished <br />under this Contract will be new unless otherwise sped. <br />tied, and that all work will be of good quality, free irom <br />faults and defects and in conformance with the Cowfact <br />Documents, All Work not eonformong to these require• <br />ments. including substitutions not properly appro, ed and <br />authorized, ma+ be conetdered defective. If required by <br />the Architect. the Contractor shall furnish satisfactory evi. <br />dence as to the kind and quality Of materials and equip- <br />ment. This warranty is not limited by the provisions of <br />Paragraph 13.2, <br />4.6 TAXES <br />4.6.1 The Contractor shall pay all sales. consumer, use <br />and other similar taxes for the Work or portions thereof <br />Provided by the Contractor which are legally enacted at <br />the time bids are received. whether or not yet effective. <br />4.7 PERMITS, FEES AND NOTICES <br />4.7.1 Unless otherwise provided in the Contract Docu. <br />ments. the Contractor shall secure and pay for the build. <br />ing permit and for all other permits and governmental <br />fees, licenses and inspections necessary for the proper <br />execution and completion of the Work which are custom- <br />arily secured after execution of the Contract and which <br />are legally required at the time the bids are received. <br />4.7.2 The Contractor shall give all notices and comply <br />with all laws, ordinances, rules, regulations and lawful or- <br />ders of any public authority bearing on the performance <br />of the Work. <br />4.7.3 It is not the responsibility of the Contractor to <br />make certain that the Contract Documents are in accord- <br />ance with applicable laws, statutes, building codes and <br />regulations. If the Contractor observes that any of the <br />Contract Documents are at variance therewith in any re- <br />spect, he shall promptly notify the Architect in writing, <br />and any necessary changes shall be accomplished by ap- <br />propriate Modification. <br />4.7.4 If the Contractor performs any Work knowing it to <br />be contrary to such laws, ordinances, rules and regula• <br />tions, and without such notice to the Architect, he shall <br />assume full responsibility therefor and shall bear all costs <br />attributable thereto. <br />4.8 ALLOWANCES <br />4.8.1 The Contractor shall include in the Contract Sum <br />all allowances stated in the Contract Documents.
