CASE NUMBER: 1597-85
APPLICANT: Burger King Corporation
suggest that an appropriate
construction of a right -turn lai
Cleveland, north of the entrance.
with the applicants who agree that
condition in the event that moving
a stacking situation.
Page 2
solution would be the
ie on the west side of
We have discussed this
this could be added as a
traffic is impeded by such
5. The variances requested are for a six (6) foot setback for
the drive -through area from the north property line, where
normally 15 feet is required.
The building setback is proposed to be 25 feet rather than
t•he 30 feet required. The building has to be located this
far north of the property line because of the existence of
the power line easement. Thus, this unique condition
constitutes a physical hardship on the site, qualifying for
the variance application.
You will note from the site plans attached that the boulevard
area on the south side of County Road C is very wide, being
some 40 feet in width. Thus, the reduction in these setbacks
on the north side of the structure will not be discernible to
the passing public.
6. You will notice too, that the Burger King people have been
successful in acquiring an easement for 30 feet of land
within the railroad right-of-way on the south side of the
site. This provides adequate space to overcome the narrow
condition of the property and provide the required parking
for the facility.
7. All the signs proposed for the ,ite are within Ordinance
requirements, except that the sign proposed to be put on the
sloped roof is by Ordinance definition a roof sign. Such
signs are prohibited by Ordinance. Such a sign can be on
the roof if the slope of the roof is 60 degrees or less.
This allows for the placement of a sign on a so-called
"mansard" roof, which is normally near perpendicular.
In this case, the roof has a pitch of 7 in 12, which is
slightly less than 45 degrees. The roof system on this
structure is, however, a mansard in the sense that there is
an open well inside at the top of the roof line where
mechanical equipment is placed and thus hidden from view.
The applicants have been examining other possible locations
for the sign, and may request a variance at a subsequent
meeting for the placement of the sign on the roof.
8. The action requested, in summary, is for a rezoning from B-4
to B-3 and approval of a Special Use permit for a
drive -through facility. The variances are for setback
requirements on the side yard facing the street (the east
