result in the inability of Roseville to comply with the <br />provisions of this permit, the Roseville Community <br />Development Director shall notify the Director the next <br />working day. <br />D. Design Changes. Before implementing any design change, the <br />permittee desiring the change shall inform the Director of <br />the design change and shall submit for review and approval <br />such information as the Director may require to determine <br />the effect of the design change. <br />E. Noise. " <br />1. Requirements of the Developers and Builders. To <br />control noise at the project, the second permitt.ee <br />shall require that all developers and builders, as a <br />condition of all grading and/or building permits on <br />the project for which the second permittee may <br />authorize construction, comply with the conditions <br />below. Whether or not the first permittee is the <br />developer and/or builder, the first permittee shall <br />either perform the items set forth below or require <br />all subsequent developers and their builders as a <br />condition of any lease, sale, or development agreement <br />comply with the conditions below: <br />a. ensure that all engines and engine -driven <br />equipment used in construction and/or <br />maintenance of the project are fitted with <br />adequate mufflers that are properly maintained <br />and Ln constant operation; <br />b. ccimply with any additional requirements of the <br />nol.se ordinance of Roseville; and <br />C. comply with any additional requirements of Minn. <br />Rule, Parts 7010.0010 to 7010.0080; <br />2. Noise Plan <br />In addition to any requirements set forth in E.1. <br />above, the first permittee shall submit to the <br />director a plan detailing a method for compliance with <br />State Noise Standards set in Minn. Rules Parts <br />7010.0010 to 7010.0080 at the hotel referenced in <br />Part I. Compliance with standards may be demonstrated <br />through a reduction in noise reaching the site, <br />through the exceptions detailed in Minn. Rules Part <br />7010.0050 Subp.3, or through other methods <br />acceptable to the Director. The first permittee shall <br />receive written approval of the plan from the Director <br />before commencement of construction at the hotel site. <br />-5- <br />
