0 <br />a. the modification would lead to a material adverse <br />effect on air quality by altering mobile source <br />activity. <br />b. the modification would violate any special <br />conditions or general conditions contained in <br />Part III. and Part IV. of this permit; or <br />ce the modification would (a) contradict the <br />submitted information referenced in Part II.C.1., <br />and (b) lead to a material effect on air quality <br />by altering mobile source activity. <br />7. Developer. The term "developer" shall mean any person <br />or persons who are seeking or have sought site plan <br />approval from the Roseville City Council for any <br />portion of any project covered by this permit. <br />8. Director. The term "Director" shall mean the <br />Director of the Division of Air Quality of the Agency. <br />PART III. SPECIAL CONDITIONS <br />A. Authorization of construction. The first permittee is <br />authorized to construct the Centre Pointe Business Park and <br />associated parking as specified in Parts I. and II., and <br />subject to prior receipt of authorization of construction <br />from the second permittee. Modifications of the <br />project as to amounts and types of land uses shall be <br />subject to the provisions in Part III.D, Design Changes, <br />if they consititute design changes. <br />B. No Actions CO Violate Permit. The second permittee shall <br />authorize construction, and/or allow construction to proceed <br />once it has commenced, and/or authorize occupancy, for any <br />Portion of the project including associated parking covered <br />by this permit, only if the conditions of this <br />permit <br />been met. In addition, the permittees shall use best have <br />efforts to prevent or restrain any of their employees or any <br />person retained by the permittees on a fee for service basis <br />from knowingly taking actions, promoting <br />Signing contracts which encourage developers ior`builders of <br />the properties constructed persuant to the authority of this <br />permit to violate the terms of this permit. <br />C. Notification of Change.
