Basis for Special Conditions: <br />To ensure that the hotel is in compliance with the NAC-2 <br />standards, conditions have been included in the permit to <br />require a noise abatement plan be submitted to and be <br />approved by the Director of the Air Quality Division at <br />MPCA before construction of the hotel commences. Air <br />quality estimates rest on the assumption that traffic is at <br />the volumes assumed, and that the trips attracted to and <br />originating from the Business Park will be distributed as <br />assumed. <br />Aonlicable Statutory Regulatory Provisions <br />This permit is issued pursuant Minnesota Statutes Chapters <br />115 and 116 (1988), Minn. Rules Parts 7001.0010 to <br />7001.0210, Rules Relating to Permits, Minn. Rules Parts <br />7001.1250 to 7001.1350, Rules Relating to Indirect Source <br />Permits, State Noise Standards set forth in Minn. Rules <br />Parts 7010.0010 to 7010.0080, and Minn. Rules Part <br />7005.0550, A Rule Relating to Control of Fugitive <br />Particulate Matter, <br />D. REQUESTED VARIANCES <br />No variances nre needed or have been requested for this <br />project. <br />E. APPLICABILITY of CHAPTER 116D <br />This permit is issued pursuant to requirements contained in <br />Chapter 116D.03 (a), (e), and (d), particularly with respect <br />t 0 : <br />Coordination with other government agencies concerning air <br />quality and traffic forecasts. <br />F. PRELIMINARY DETERMINATIONS <br />The Director has determined that a modified permit should be <br />issued, subject to Special and General Conditions contained <br />therein, inasmuch as the permit meets the requirements of <br />Minnesota Rules stated in C. <br />G.
