If the Ramsey County Surveyor proceeds on this <br />schedule then, unless there are unanticipated problems, John <br />should have the comments of the Ramsey County Surveyor by the <br />beginning of November and should be able to complete the final <br />mylars by the end of the first week of November. This suggests to <br />me that we should be able to present the plat to the City for <br />final approval at the Council meeting on either November 13, 1989 <br />or November 27, 1989. <br />On behalf of my client, Woodbridge Properties, I <br />respectfully request a further extension of the time for approval <br />of the final plat through November 27, 1989. I will keep you <br />informed if, for any reason, it appears that it will not be <br />possible to have the plat for final approval by the 27th of <br />November and if further extension will be necessary. It is very <br />important to my client that the plat be filed this year because, <br />if the plat if filed after the first of the year, it will be <br />necessary for my client to pre -pay at the time of the recording <br />of the plat all of the taxes due and payable in 1990. <br />There is one matter I am aware of at this time that <br />might affect the schedule. In its recent title report, Minnesota <br />Title indicates that County Road C-2 within the area to be <br />platted has not yet been vacated. As you and I discussed, <br />however, the City passed a resolution vacating County Road C-2. <br />Steve Gatlin confirmed that the City had jurisdiction over County <br />Road C-2 within the plat and that the consent of the County for <br />such vacation was unneccessary. Nonetheless, Minnesota Title is <br />still questioning this point. I have asked Steve for his <br />assistance in checking of his records to find the basis for the <br />City's authority to vacate County Road C-2. The cooperation and <br />assistance of the City in following up on this point would be <br />very much appreciated so that we can clear up the matters with <br />Minnesota Title. <br />Please give me a call or drop me a note to confirm that <br />the extension requested here will be acceptable to the City. <br />Thank you very much. <br />Very truly yours, <br />Matthew B.
