I <br />. <br />finished surface of the floor area of the main' entry to such <br />building. <br />4. The Fine Property is hereby made subject to the restric- <br />tion that, so long as the building to be initially constructed <br />upon the Discus Property remains standing, no building will be <br />constructed on the portion of the Fine Property labeled "No Build <br />Area" on Exhibit III hereto. The foregoing restrictions shall <br />not lapse if said building or a building substantially similar <br />thereto is rebuilt or reconstructed in approximately the same <br />location on the Discus Property and such rebuilding or reconst:,uc- <br />tion is substantially completed within one (1) year after the <br />date of the destruction, substantial damage or removal of the <br />existing building, whichever first occurs. The foregoing re- <br />striction shall not be applicable to signs, lights, parking <br />improvements, landscaping, or any similar improvements. <br />5. The Fine Property and the Discus Property are each <br />hereby made subject to the restriction that no building will be <br />constructed closer than 15 feet from the common boundary between <br />said Properties. The Fine Property is hereby made subject to the <br />further restriction that if a building is constructed upon the <br />Fine Property closer than 24 feet from the common boundary between <br />the Fine Property and the Discus Property, and if Discus so <br />requests in a written request delivered to Fine within one year <br />after substantial completion of construction of such building, a <br />fence or pl-intings of Fine's choosing but not less than 4 feet <br />.6- <br />
