surface drainage from the Property onto the Discus Property <br />and into any storm drainag stem constructed thereon. No <br />building or other improvement nor any landscaping shall be con- <br />structed, erected or placed on the Discus Property which would <br />significantly interfere with the surface drainage permitted by <br />the foregoing easement unless alternative facilities and arrange- <br />ments to accommodate the surface drainage from the Fine Property <br />are, contemporaneously constructed on the Discus Property. <br />Notwithstanding the foregoing, in the event that the r-.ne Property <br />is developed subsequent to the Discus Property, Discus shall have <br />the right to approve the drainage plan for Fine's Property as it <br />affects the Discus Property which approval shall not be unreasonably <br />withheld or delayed. Fine agrees that in the event that the Fine <br />Property is developed subsequent to the Discus Property that <br />Fine's drainage plan will. not provide for drainage onto the then <br />existing landscaping areas of the Discus Property. <br />11. Discus, for itself and future owners of the Discus <br />Property, agrees that the owner of the Discus Property will not <br />object to the rezoning of Lot 2, Block 2, Venture Addition, <br />according to the recorded plat thereof on file in the office of <br />the County Recorder, Ramsey County, Minnesota, to any business or <br />commercial zoning classification (but not industrial) now or <br />hereafter in effect in the City of Roseville. <br />12.
