the Temporary Roadway Easement Area and the construction of the <br />roadway and parking areas subject to the permanent easement above <br />described shall be at the sole cost and expense of the owner of <br />the Fine Property. Additionally, contemporaneously with the <br />construction of the roadway and parking areas on the Fine Property <br />described above, the owner of the Fine Property shall have the <br />right at its sole expense to enter upon the Discus Property, <br />remove the "Removable Islands" identified on Exhibit III hereto <br />and any other parking area islands located within 40 feet of the <br />common boundary between the Fine Property and the Discus Property, <br />surface the area previously occupied by any Removable'Islands or <br />other parking area islands so removed and extend any parking bays <br />on the Discus Property which terminated at the parking area <br />islands so removed to the common boundary between the Fine Property <br />and the Discus Property. The Discus Property is hereby made <br />subject to the restriction that no buildings or improvements <br />shall be constructed, altered or replaced thereon unless the <br />Removable Islands, or any other parking area islands located <br />within 40 feet of the common boundary between the Discus Property <br />and the Fine Property may be removed without violating any law or <br />ordinance relative to minimum landscaping requirements applicable <br />to the Discus Property. <br />10. Discus hereby grants to Fine, a permanent, non-exclusive <br />easement appurtenant to the Fine Property for surface drainage <br />purposes.
