LJ
PLANNING REPORT
DATE:
CASE NUMBER:
APPLICANT:
LOCATION:
ACTION REQUESTED:
•
4 March 1987
1729
Peter S. Luzaich
Southwest Corner of Rice
Street and County Road B2
Variance to Building and
Parking Setback
PLANNING CONSIDERATIONS:
1. This property is zoned B-3 and has been occupied by a one story
wooden frame building housing a combination rear hall and restaurant.
This building has existed since the Township era preceding the formation
of the Village in 1948. Attempts have been made to consider reuse of
the existing building, but you will note from. the attached drawing
showing "the existing conditions" that the structure is roughly ' in the
middle of the property, making it difficult to provide adequate parking
on the site. The structure is also substantially substandard and
dilapidated.
2. The current buyers of the land propose to construct a 3,200 square
foot, two story office building on the site to house a real estate
operation owned by the applicant. The site is extremely small and will
measure 110.44 feet of the frontage of County Road and 109 feet of
frontage on Rice Street. These dimensions will apply after 16-1/2 feet
of frontage is dedicated along Rice Street as required by City policy.
Dedication of the 16-1/2 feet, of course, makes the site even smaller
than it was and creates considerable hardship in attempting to utilize
the property in an efficient and reasonable manner.
3. The proposal presented is to build a two story office building in the
southwesterly corner of the site, adhereing to the required
10 -Foot
setback for the side yard along the south property line. This
side of
the property is contiguous to a medical clinic which was
built
approximately ten years ago. The location to that structure
and its
contiguous parking to the property in question is shown on the
"existing
conditions" drawing attached. The building is located within 6
feet of
the westerly property line, contiguous to a residence owned
by John
Andert. Mr. Andert has provided a statement (a copy of
which is
attached) approving the variance. The letter, you will note,
indicates
his approval of a variance of 6 feet. Because this west
side is
theoretically the rear of the property, the normal setback is
20 feet.
The parking required for the structure at 5 spaces per 1000 square feet
equals 16 spaces. A total of 1.8 spaces are provided.
