CASE NUMBER: 1590-85 <br />APPLICANT: Christian & Missionry Alliance Church Page 2 <br />intensity use, and the residential quality of the structure <br />is obviously a factor in the neighbors' perception of its <br />compatibility with the contiguous residential zones. <br />Examination of the attached portion of the Zoning Map <br />illustrates a somewhat precarious position of this property <br />for single family residential purposes. The land to the <br />south (across Garden Avenue) is zoned and used for B-2, <br />Retail, purposes. The property across Lexington Avenue is <br />zoned B-2 as well. <br />Thus, there is some merit to the development of the land in <br />question for a Limited Business transitional use. The actual <br />use of the property for the structure as proposed will, in <br />fact, increase the land values in the area inasmuch as the <br />potential threat for some more deleterious use will be <br />negated. Thus, though it adds another commercial use on <br />Lexington Avenue, it appears to solve a problem with which <br />the neighbors have been concerned for some time. <br />5. Though the attached letter speaks of a rezoning, the action <br />before the Planning Commission and Council at this time is <br />one of an amendment to the Comprehensive Plan which must <br />precede a rezoning, action. The request then is for an <br />amendment from the designated Low Density Residential Use to <br />a Limited Business Use. <br />If the Planning Commission recommends approval of the land <br />use change, a hearing for the rezoning can be published for <br />the June meeting of the Planning Commission. If the Council <br />approves the amendment in the meantime, the timing of the <br />rezoning will conform to Metropolitan Council requirements <br />for their review and action. <br />Following a possible Council action of approval on the second <br />Monday of the month, the Metropolitan Council has ten days <br />within which to declare a negative declaration. Such a <br />declaration determines that the land use change does not have <br />metropolitan impact (very likely in this case). Thus, there <br />is time for this action prior to a potential Planning <br />Commission hearing on the rezoning at their regular June <br />meeting. <br />
