That there shall be no unreasonable interference with navigation by the e=istence or use of the activity authorized <br />herein. <br />t That this permit may not be transferred to a third party without prior written notice to the District Engineer, either by <br />the transferee's written agreement to comply with all terms and conditions of this permit or by the transferrer subscribing to <br />this permit in the space provided below and thereby agreeing to comply with all terms and conditions of this permit. In addi- <br />tion, if the permittee transfers the in;aresta authorized herein by conveyance of realty, the deed shall reference this permit and <br />the farms and conditions specified herein and this permit shall be recorded along with the deed with the Register of Deeds or <br />other appropriate official <br />u. That if the permitter during prosecution of the work authorized herein, encounters a previously unidentified ar• <br />theological or other cultural resource within the area subject to Department of the Army jurisdiction that might be eligible for <br />listing in the National Register of Historic Places, he shall immediately notify the district engineer. <br />11. SWIM Conditions: (Here Wt conditions rrlatiAs specifically to the proposed structure or work authorised by this permit): <br />I. The Following Activities are Excluded from this General Permit: <br />a. Activities denied by any agency or municipality having permitting <br />authority. <br />b. Activities which do not conform to an approved land —use plan (e.g. <br />municipal and county ordinances, municipal wetland protection and <br />management plans, tribal ordinances, etc.). <br />c. Activities which would have more than a minimal effect on the <br />quality of the human environment in a singular or cumulative manner. <br />d. Fills to develop land for housing. <br />e. Fills for industrial development. <br />f. Fills for commercial development. <br />g. Fills associated with the activities listed on Page IA through 1F, <br />for purposes of general landscaping (lawns, gardens, parking lets, etc.). <br />h. Activities in or affecting components of a designated Federal or <br />State Wild and Scenic River System (See Attachment). <br />i. Activities on Federal lands unless performed by, or approved or <br />authorized by, the administrating (managing) agency. <br />j. Activities which would have an adverse effect on navigation (if <br />considered unacceptable by the Corps). <br />k. Activities which may have an effect on Federally —listed endangered <br />or threatened wildlife or plants, or their critical habitat. <br />1. Activities failing to receive MDNR authorization. <br />m. Activities which would have an adverse effect on a known <br />archaeological site. <br />n. Activities involving the excavation or discharge of material- <br />containing toxic or hazardous pollutants in concentrations sufficient to <br />-` <br />invoke 'a licable pp provisions of the Toxic Substances Control Act or the <br />Resource Conservation and Recovery Act. <br />o., Activities in which the MDNR's3decision is overturned by a court of: <br />.r <br />law. <br />m <br />
