4
4r
Mr. George Reiling
September 14, 1987
Page Two
3) A small inland channel could be excavated aajacent to each
two (2) contiguous end lots (i.e. Lots 1 & 2, and Lots 9 &
10) to provide shared access with the remaining lots.
4) No excavation as proposed by you.
The quantity of work authorized will depend on how much of your land
is actually platted, and access from each lot to any of the
alternatives listed above would have to be by easement or other means.
As requested, I have enclosed a copy of the rules which discuss the
scope of excavation and non -permitted excavation, respectively,.
Please note that a permit to excavate in a DNR Protected Vater is
required involving "proposals for excavations landward or waterward
from the ordinary high water mark". Also, Lots 1 and 2 - Block 2, and
Lot 1 - Block 3 are not riparian to the lake and therefore, have no
legal right to access the lake.
Please look over the alternatives I have proposed and/or any
additional ideas ycu may have and indicate if you are interested in
implementing any of them. As stated earlier in this letter, we would
not be able to issue a permit as proposed in your application.
Should you hc-.e any questions, please don't hesitate to contact me.
Sincerely,
J n G.
