REQUEST FOR COUNCIL ACTION <br />Department Approval: Manager Reviewed: Agenda Section: <br />Hearing <br />Item Description': <br />George Reiling request for final plat at 2815, <br />2834 and 2835 Victoria Street. <br />The City Council at its May 9, 1988 meeting approved George <br />Reiling's request for a preliminary plat at 2815, 2834 and 2835 <br />Victoria Street. The hearing for the final plat was originally <br />scheduled for June 13, 1988 but has been continued numerous times in <br />an attempt to resolve the issue of parkland dedication as it would <br />pertain to this particular plat. The land area within the proposed <br />plat has been determined to be over 5 acres which would require a <br />10% land dedication or equivalent cash by Mr. Reiling. Mr. Reiling <br />agreed to consider fulfilling the dedication requirements by <br />dedicating approximately 1/2 acre of the unbuildable portion of the <br />site currently occupied by cat tails. The Parks and Recreation <br />Commission at their April 3 meeting, recommended that the City <br />request money instead of the proposed land dedication based on <br />public inaccessibility to the proposed land dedication. Mr. Reiling <br />is opposed to making any cash payments and has stated that he would <br />withdraw the plat rather than pay cash to meet the dedication <br />requirements. <br />This matter is scheduled to come before the City Council on April <br />24, 1989. Mr. Reiling has asked that the City Council make a final <br />'slue before <br />he prepares <br />determination on the parkland dedication i p p <br />final plat information for approval by the Council. The options at <br />this point, appear to be as follows: <br />1. Waive parkland dedication requirements as being unnecessary. <br />2. Accept the 1/2 acre land dedication as shown on the attached <br />map prepared by the City's Public Works Department. <br />3. Require cash in lieu of land as recommended by the Parks and <br />Recreation Commission. <br />COUNCIL ACTION REQUESTED: Motion to determine the City's position <br />concerning parkland dedication <br />requirements as they would apply to <br />
