VIEWED/RECOMMENDS: <br />� <br />Shorewood Corporation request for rezoning (� <br />v and special use permit at 2231 Rice. \ <br />The Planning Commission, at its August 1st meeting, unanimously recommended <br />approval of Shorewood Corporation's request for rezoning and Special use <br />permit to allow a building with 61 units at 2231 Rice, with the following <br />conditions: <br />1) That the platting of the three new parcels be completed. <br />2) That the relocation of the sanitary sewer and the construction of the <br />water main be done to City standards. <br />3) That additional easements for new public utilities be recorded, and <br />that the old easements be vacated. <br />4) That proposed landscaping, trees in particular, be kept off utility <br />easements. <br />5) That joint driveway and access easements between all parcels be <br />recorded. <br />6) That approval from the state for filling activity on State right-of-way <br />be secured. <br />7) That the developer work to reduce the driveway grades as much as possible. <br />8) That additional right-of-way to 49.5 feet be dedicated along Rice Street. <br />9) That a nonmotorized pathway be constructed along Rice Street, but not <br />across the Country Kitchen parcel. <br />10) That drainage plans be subject to Staff review. <br />11) That the access easement ,leading west of the parcel to clarion Street be <br />vacated. <br />12) That the project be developed according to plans dated 7/2/84. <br />There was a misunderstanding between the developer and City staff regarding the <br />need for a plat for the development. The developer has indicated a desire to <br />create separate lots for the apartment building and the office building. In <br />addition, a portion of the northerly property is to be divided off and retained <br />by the Country Kitchen owners. The creation of 3 or more new parcels requires <br />a preliminary plat. <br />The developer has indicated lie will proceed with the platting process, but <br />would like the Council to take action on the rezoning and special use permit <br />at this time. <br />Attached is the Planner's report. Council previously received the drainage, <br />utilities and site plans. <br />
