Application <br />Date: December, 7, 1964 <br />TANURB Development, Inc. have been working with the city staff for several <br />months to develop a 180,000 s.f. shopping center on the 13 acre site in the NE <br />quadrant of Fairview and County Road B2. As a part of the development, they <br />have requested several different types of actions by the city. <br />The first type of requested required hearings before the planning commission and <br />the (-)uncil. These are requested to occur in January wit'. concurrent <br />advertisement desired. <br />1. Rezoning to Shopping Center <br />2. Approval of a special use permit which is required for this type of <br />zoning <br />3. Approval of seven variances to building or parking requirements of <br />the code <br />4. Vacation of rights -of -way for the four roadways located on the site. <br />Before acting on the request to establish the concurrently advertised hearings, <br />however, the council should neigh the accompanying; requests from the developer <br />and the material submitted to justify the requested city actions. Although <br />substantial material has been submitted with the request, several items <br />concern the staff. <br />In regard to the hearing related items: <br />1. The applications are still unsigned. The developers representative <br />indicated that this would be accomplished by Monday, Dec. 10, 1984. <br />2. The request to vacate the existing street rights -of -way makes no <br />provision for providing temporary easements, until the existing <br />owners no longer live on the site, or for the granting of permanent <br />easements for public sanitary sewers, and roadways necessitated by <br />the development. <br />3. No abstract of adjacent ownership is provided. Tclis is promised <br />within two weeks. <br />4. The relationship of sight lines from Fairview, or adjacent homes to <br />the north, onto the roofs of the east wing is a concern which is <br />unresolved. The sight line study is promised within two weeks. <br />5. The lighting plan is generally complete, but a specific fixture sketch <br />is unavailable. This is promised within one week. <br />
