Under the B-3 zoning <br />regulations, there is required a 20 foot setback on this side of the <br />lot. The applicant is requesting that this be reduced to five feet. <br />The building on the west side is setback 50 feet from this property <br />line, which as a side lot would normally require a tt_n foot setback. <br />Thus, the five foot setback on the north side is really a question of <br />reorientation of the lot to the east rather than to the south. <br />6. The applicant is also requesting a reduced setback from 15 feet to five <br />feet contiguous to the new right-of-way on the south side of the <br />property. There is no hardship involved here except that the City is <br />acquiring part of the land for right-of-way purposes. If approval of <br />this setback is reflected in agreement on a reasonable price for the <br />right-of-way, is may be an appropriate consideration. It is true that <br />the acquisition of the 60 foot of right-of-way reduces the potential of <br />the property. If the City pays the same price for the land as the <br />applicant, the acquisition of the right-of-way should have relatively <br />little adverse impact. However, if the City pays substantially less <br />than the applicant is paying for the land Con a per square foot basis) <br />this "hardship" could be mitigated to a degree by a reduction in the <br />amount of setback required to the parking. This in effect allows more <br />building to be placed on the remaining land, and thus increasing its <br />value beyond what the normal development regulations would accommodate. <br />7. The applicant proposes to build the structure this year, and provide a <br />temporary driveway along the 60 foot of right-of-way they now own at the <br />the southwest corner of the site. Thus, access would be provided via <br />County Road 6 at that southwest corner. Ultimately, when the service <br />road is complete, a new driveway would he located on the east -west <br />portion of the service road and the driveway that would be constructed <br />initially at the southwest would be eliminated. <br />8. The proposed structure is a brick and stucco building which is proposed <br />to be treated along all four sides. You will note that the elevation of <br />the west side indicates the middle panel, near the roofline, is to <br />terminate. The applicant has agreed, however, to extend these panels <br />around the entire west side so the structure will be finished the same <br />on all four sides. This is important in this case because there is an <br />existing relatively new office building contiguous to the property on <br />the west side. Thus, the rear of this structure will be highly visible <br />from that property. <br />9. We have also discussed with the applicants the handling of the trash <br />containers on the site. We suggest that if the variances are allowed, <br />that it be on the condition that the trash containers be located inside <br />the building. The applicant has agreed to this condition. <br />
