M <br />1. Easements and parking Lot Set Back Variance. <br />(a) The Developers hereby agree to grant to the City an <br />easement. of approximately nea d aol6road l/2 footht-of-way on the <br />easeme t on the <br />east side of Lexington Avenue <br />west side of Lexington Avenue. <br />(b) In consideration of the Developers' granting of the <br />accordance with the <br />above referred easements, the City has, in acmade the necessary <br />applicable provisions of the Mtawy parking lot set back <br />findings and has granted to the <br />Developers <br />variances for the Existing Development and the Project as <br />follows: <br />(i) to 0 feet on both the east and west sides of <br />Lexington Avenue for the entire length of the Existing <br />Development and the Project; <br />( i i ) to 0 feet on both the north and south sides ghtf <br />Dionne Street beginning at the east Lexington <br />of -way line and running altbothethes northarty <br />nd <br />line of the Existing Development on <br />south sides of Dionne Street; <br />(iii) to 8 feet on the south side of Roma Street be- <br />ginning at the northeast corner est of said northwest <br />Development to a point 145 fee <br />corner, and to 0 feet thence to the east property line <br />of the Existing Development; <br />nue <br />(iv) to 7 feet on north <br />hcorne of of arpenteur Larpenteur Band <br />from the northeast property <br />Lexington to a point 160 feet east; <br />all of such variances to continue for so long as the Existing <br />Development and the Project are used for purposes that are per- <br />mitted or conditional uses in the B-2 Zoning District and the <br />building configuration is not changed where it is adjacent to one <br />of the variances hereinabove set forth. <br />(c) The Developers hereby agree to grant the city a <br />right-of-way for pedestrian purposes of approximately 7 feet <br />along the south side of the Existing Development for the length <br />of the Existing Development. <br />2. Landscaping for Parking Lots. <br />(a) The Developers hereby agree to submit to the City a <br />plan for landscaping the Existing Development and the Project, <br />which landscaping will be installed at the sole expense of the <br />Developers. The landscaping shall not be installed until the <br />The <br />plans for the landscaping have been approved by the City. <br />Developers agree to be responsible for maintaining the <br />andscaping as long as the Existing Development and 11 the Project <br />exist. <br />3 <br />
