..I <br />(b) Subject to the Developers obtaining any necessary <br />permit from the County of Ramsey, the City hereby agrees that the <br />landscaping and any related irrigation or lawn sprinkler system <br />required in paragraph 2(a) above may be installed by the Develop- <br />ers in the rights of way granted to the City by the Developers <br />pursuant to paragraph l(a) above. The City agrees that it will <br />not take any action which would damage the landscaping and <br />related irrigation or lawn sprinkler systems unless necessary in <br />connection with the installation or repair of public improvements <br />and will restore the property, landscaping, and irrigation or <br />sprinkler system upon completion of such installation or repair. <br />3. Parking. <br />(a) The City <br />on the north and south <br />side of Roma Street as <br />tinue to be allowed for <br />paragraph l(b) hereof. <br />hereby agrees that the "head -in" parking <br />sidle of Dionne Street, and on the south <br />currently allowed by the City shall con - <br />the duration of the variances granted in <br />(b) The Developer shall provide handicap parking spaces <br />in the Existing Development and the Project in such locations and <br />number as are customary in parking lots of -similar size and use. <br />4. Petition for Public Improvements. <br />(a) The Developers hereby agree to execute petitions <br />for public improvements in substantially the form attached hereto <br />as Exhibit C, which petitions shall request the City to construct <br />(i) curb and gutter, paving, and any necessary drainage improve- <br />ments on Dionne Street from Lexington Avenue east to the property <br />line of the Existing Development; and (ii) sidewalk improvements <br />on the north side of Larpenteur Avenue from Lexington from the <br />southwest corner of the Existing Development to a point 160 feet <br />east; and (iii) curb and gutter, paving and necessary drainage on <br />the portion adjacent to property on Roma Street from Lexington <br />east to the property line of the Existing Development (col- <br />lectively, the "Public Improvements"). The Developers hereby <br />represent to the City that it owns 100% of the property affected <br />by the Public Improvements and that it will pay 100% of the costs <br />of the Public Improvements. <br />(b) The Developers further agree to pay costs associ- <br />ated with the preparation of a developer's agreement as per state <br />statute 475.65 which costs shall be assessed one half against the <br />Project and one half against the Existing Development. <br />(c) <br />The <br />City agrees to assess the cost of the Public <br />Improvements <br />and the costs referred to <br />in paragraph 4(b) over a <br />term of 15 years, <br />with interest on the <br />unpaid balance accruing at <br />an interest <br />rate <br />which is 1% over the <br />interest rate on bonds <br />i ued by the <br />City <br />to finance the Public <br />Improvements. <br />4 <br />
