Nays: <br />None. <br />Curley moved, Kehr seconded that Resolution 7685A, approving the <br />vacation of public streets and releasing public utility easements <br />at 2480 Fairview Avenue be adopted. Nays: None. <br />Curley moved, Kehr seconded that Ordinance 967, rezoning the property <br />at 2480 Fairview Avenue from R-1 to Shopping Center be adopted. Roll <br />Call, Ayes: Curley, Kehr, Johnson, Franke and Demos. Nays: None. <br />-2 Franke moved, Curley seconded that Ashland Oil Company's application <br />for ;special use permit and variance to setback at 2172 Lexington <br />Avenue be approved, with the following conditions: <br />1) That the property be developed in accordance with the site plan <br />dated January 22, 1985. <br />2) That an additional ten feet of right-of-way for County Road 8, <br />and sixteen feet, six inches of right-of-way for Lexington Avenue <br />be dedicated. <br />3) That the staff review the need for a fence on the north property <br />line adjacent to the apartment building, and evaluate whether a <br />species of tree other than the proposed Sugar Maple should be <br />used. <br />Roll Call, Ayes: Curley, Franke, Johnson, Kehr and Demos. Nays: <br />None. <br />9-3 Johnson moved, Franke seconded that Ettinger Transfer and Leasing <br />Corporation's application for special use permit at 2360 County Road <br />C be approved with the following conditions: <br />1) That the development be constructed in accordance with site plan <br />dated 9/1/84, and revised 1/15, 1/21, and 1/29, 1985. <br />2) That the drainage, utility and landscaping plans be approved by <br />staff. <br />3) That in lieu of constructing a sidewalk, the applicant shall <br />deposit with the City an amount which is equal to the estimated <br />cost of the sidewalk. <br />RESOLUTION <br />7685a <br />ORDINANCE <br />967 <br />ASHLAND <br />OIL CO. <br />ETTINGER <br />CORPORATION <br />
