REKUSKI <br />YOUR FILE NO. 1089 <br />OUR FILE NO. 1011.58 <br />Dear Mr. Lyons: <br />I acknowledge receipt of your letter of January 25, 1989. <br />Mr'. Rekuski is not prevented from occupying his home at 1225 <br />Josephine. <br />The only <br />prohibition on occupancy is found in the Roseville Code, <br />Section 20.13 <br />0. <br />"20.130. Occupancy Permit. No occupancy <br />permit shall be granted for the use of any <br />structure within a subdivision approved for <br />platting or replatting until required utility <br />facilities have been installed and made ready <br />to service the property., and roadways <br />providing access to the subject lot or lots <br />have been constructed or are in the course of <br />construction and are suitable for car <br />traffic." <br />I am assuming that Mr. Rekuski's home meets all the requirements <br />of that section. <br />However, the position of the City of Roseville is that the <br />Rekuski home violates the zoning and building codes and we have <br />an action pending.
