-2-
3. Lack of variance and permits, required by Roseville Lakeshore
Ordinance and Rice Creek Watershed rules, to build the lot line
retaining wall within 75 feet of the lake.
4. Lack of variance and permit, required by the above, to build a
4 foot lake frontage retaining wall.
5. Lack of variance and permit, required by the above laws, to build
an additional retaining wall and elevated 6 inch concrete slab
patio between the house and lake. These were completed on September,
16, 1988.
6. Lank of variance to construct a new elevated (3 feet) drivesway.
7. Il'legal occupation of a new structure without a Certificate of -
Occupancy (from June 1, 1988 to present).
f sance
All of the above has been done through continued nonfeasance and malfeasance.
by the City of Roseville and its employees. To the best of our knowledge,
there have still been no criminal charges filed nor citations issued by the
City against the perpetrator.
We believe this illegal intrusion on our property and our expected pursuit
of happiness, as long-time law-abiding and community involved citizens, was
done by the perpetrator to maximize his personal monetary return on said
ut fear of recrimination because of his
property. This was done witho
professional knowledge of the grievous lack of enforcement of codes in this
community.
We ask for the right as victims to be allowed to deal directly with Mr.
Rekuski to resolve this problem. This'is possible if you deny the variance.
We leave to you the enforcement of the codes listed above (under "B") which
should concern you most.
We feel the Planning Commission should be concerned with prospective
deliberations rather than pardoning people for past offenses.
We feel that the elected officials cannot fairly adjudicate this matter
since ultimately they are responsible for the shortcomings of city
employees.
In order for you to be more fully informed, we invite any or all of you to
enter our property to view all structures prior to your deliberations.
Respectfully,
Bunny A. Larson Vaughn A. Larson
Addendum: Add above under "B":
8. September 23, 1988; height of retaining walls were increased in
preparation for increased patio size (est. add 10 x 30 ft) on
lakeside. Where will it end?
VLL:lw
