.KRAUS-ANDERSON REALTY COMPANY <br />DEVELOPMENT • LEASING • MANAGEMENT <br />October 21, 1988 <br />Council Members and All Concerned <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br />Dear Council Members and All Concerned: <br />This letter is in regard to an application for a Special Use <br />Permit for Roseville Billiards, a family oriented, <br />non-alcoholic establishment to be located in our Hamline <br />Shopping Center. <br />On October 12, 1988, the Planning Commission voted unanimously <br />to recommend placement of Roseville Billiards in Hamline <br />Center. As part of their recommendation, the Planning <br />Commission suggested that the Special Use Permit be granted <br />for a period of one year. Although we appreciate the Planning <br />-ommission s support on this issue, the purpose of this letter <br />is to ask for your consideration of a one year administration <br />review of the permit, with a possible 90 day grace period in <br />which to correct any problem, rather than requiring our <br />?roposed tenant to go through the entire special use permit <br />application process again. The reasons for this request are <br />is follows: <br />A one year Special Use Permit will mean that within <br />six to nine months application will need to be <br />started again to be sure that if delays occur, the <br />business will not need to close its doors while <br />again applying for the permit. <br />It will also mean a cost exceeding $2,000 for an <br />abstractor's certificate listing the names of owners <br />within 350 feet of the property, clerical and legal <br />fees. <br />Also, considerable time of the Planning Commission <br />and council members will again be required to <br />duplicate a process in less than a one year period. <br />The one year permit also has negative consequences <br />for the landlord and tenant because of the <br />considerable investment being made by both parties. <br />A one year permit will cause the proposed lease to <br />be considered only a one year lease term.
