1 <br />PLANNING REPORT <br />DATE: 3 August 1988 <br />CASE NUMBER: 1873 <br />APPLICANT: John T. Jenkins and <br />Alan M. Deutsch <br />LOCATION: Delwood Avenue Extended, <br />South of Oakcrest Avenue <br />(see sketch) <br />ACTION REQUESTED: Vacation of Public <br />Right -of -Way <br />PLANNING CONSIDERATIONS: <br />1. Attached is a copy of a portion of the City of Roseville's section map <br />showing the public right-of-way in question as a cross hatched area. <br />On either side of the public right-of-way in question are the lots owned <br />by' John Jenkins and Alan Deutsch. The areas shaded gray indicate <br />these lots. <br />2. The proposal on the part of the contiguous property owners is to vacate <br />that portion of Delwood Avenue between Oakcrest and the south line ' of <br />the applicant's property. If this action is taken by the City Council, <br />the property owners on either side of the affected right-of-way would, <br />under normal circumstances, be awarded title to the former public <br />right-of-way contiguous to their properties. In this case, each property <br />owner would gain 30 feet of frontage on Oakcrest Avenue. <br />3. The problem is that the property to the south is platted as an outlot <br />and is owned by the City of Roseville. Most of Outlot A is low and <br />is utilized for drainage purposes, as well as a portion of the park that <br />is owned by the City to the south of Outlot A. <br />4. Through Outlot A there is a water and sewer line. The water line is <br />located between Lots 7 and 8 on Willow Circle and extends to Willow <br />Lane (to the east) between Lots 6 and 7. Likewise a sewer line <br />extends between Lots 8 and 9 off of Willow Circle and proceeds <br />easterly to Willow Lane between Lots 6 and 7. If you look at the <br />section map carefully you will note the existence of the easements to <br />provide' for these utility lines. However, the City owns all of Outlot A <br />and there are no utility easements through Outlot A. Mr. Strong <br />informs us that Mr. John Hall, Roseville Superintendent of Utilities, is <br />concerned about gaining access to these utility lines if the extension of <br />Delwood Avenue is vacated. <br />5. Another concern is for the public's ability to get to the park. People <br />can now proceed down the Delwood right-of-way around the ponding <br />area and gain access to the park area. <br />
