John
T. Jenkins and Alan Deutsch, Case No. 1873 Page 2
6.
It is likely that there is no need to ever build a public street on the
right-of-way proposed to be vacated. However, we suggest that it
would be important to consider the retention of a utility easement and
a pedestrian easement of an appropriate width. We suggest that a 20
i
foot easement for this purpose might be considered minimal.
7.
We have enlarged a portion of the aerial photographs that' show this
a
area in the City. We have indicated the street right-of-way "in question
on the aerial photograph. You will note that a- driveway serving the
lot to the east has been constructed on the public right -of -away. We do
not know the exact location of phis driveway. This information would
be helpful if a public utility vehicle is going Lo gain access to this
.
area by using this. driveway.
Y
8.
In summary, it would appear important to protect the ;public interests.
and provide pedestrian and utility access on a reasonable basis. Care
should be taken so as not to give away the pu'-)lic's right to make:,its,:Y<
way over a parcel of land. It would appear obvijus, however; that the
development of a public street for normal vehicular purposes will likely
never be necessary on this portion of Delwood Avenue.
s
