The grade elevation of the remaining property of party of the first <br />part not subject to the ponding area may be graded at any elevation <br />above or 'below 919.7 mean sea level U.S.G.S. datum, but shall be <br />kept at an appropriate grade for the purpose of allowing ponding <br />upon that area subject to ponding. <br />TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and <br />appurtenances thereunto belonging, or in anywise appertaining, to the <br />said party of the second part, its successors and assigns, forever. <br />IN TESTIMONY WHEREOF, the said parties of the first part have hereunto set <br />their hands the day and year first above written. <br />
