WITNE;SSETH: That in consideration of the sum of $1.00 in hand paid by the said party of the second part, said parties of the first part do hereby grant and convey unto party of the second part, its successors and assigns, ,a perpetual easement for the purpose of discharging storm water, flooding, and ponding storm water upon Lot 3, Block 1, Worthdale Addition No. 2, Ramsey County, Minnesota; said easement described as follows: COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT 3; THENCE WESTERLY ALONG THE SOUTH LOT LINE OF SAID LOT 3 A DISTANCE OF 12 FEET; THENCE NORTHERLY TO A POINT ON THE EAST LOT LINE OF SAID LOT 3, SAID POINT BEING 100 FEET NORTHERLY OF THE SOUTHEAST CORNER OF SAID LOT 3; THENCE SOUTHEASTERLY, SOUTH 21 DEGREES 36 MINUTES EAST ALONG THE EAST LOT LINE OF SAID LOT 3 TO THE POINT OF BEGINNING AND THERE TERMINATING. ALSO ALL THAT PROPERTY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF SAID LOT 3 ABOVE; THENCE NORTHWESTERLY ALONG THE EAST LOT LINE OF SAID LOT 3 FOR A DISTANCE OF 233.18 FEET; THENCE CONTINUE ALONG SAID EAST LOT LINE NORTH- EASTERLY, NORTH 12 DEGREES 33 MINUTES EAST 180.41 FEET TO THE POINT OF BEGINNING; THENCE SOUTHWESTERLY, SOUTH 12 DEGREES 33 MINUTES WEST 75 FEET; THENCE NORTHERLY TO A POINT ON SAID EAST LOT LINE, SAID POINT BEING 50 FEET NORTHWESTERLY FROM THE POINT OF BEGINNING; THENCE SOUTH 8 DEGREES 27 MINUTES EAST 50 FEET TO THE POINT OF BEGINNING AND THERE TERMINATING. The City, party of the second part, shall have the right to discharge storm waters upon, and to cause flooding and ponding upon, that parcel hereinabove described as the ponding area. 2. The elevation of the parcel at the line separating the ponding area from the balance shall not be above 919.7 mean sea level U.S.G.S. datum.
