Attached to this memo is a map which we have prepared indicating the <br />street pattern and lot lines on the topographical map of this area of <br />the City at a scale of 1"=200'. Also indicated on the map is the park <br />area owned by she City, properties owned by the Sommerset 19 Condominium <br />Association, sewer and water lines in the area, and the proposed division <br />of the lot as requested by Mr. Jaeckel. For purposes of identification, <br />you will notice we have labled the street south of Third Avenue as 312 <br />Avenue. We have indicated with dotted lines the extension of 31z Avenue <br />westerly to Upper Colonial Drive. This extension currently exists as a <br />60 foot wide utility easement, under which is placed a trunk sewer line <br />draining westerly to Upper Colonial Drive. In our opinion, the principal <br />area of concern with respect to the vacation of any streets in this area <br />of the City relate to a means of access for pedestrian and vehicles from <br />the Cherry Hills Area to the neighborhood easterly of Clement Street. <br />Not only is this important in terms of efficient and reasonable vehicular <br />and pedestrian circulation, but it is absolutely vital as a means of <br />providing access to the park which serves the neighborhood to the west <br />and to the east. Currently, there is no way for persons living east <br />of Clement Street to get to the park. This is a serious deficiency. <br />2. We understand that the Sommerset 19 Condominium Association is opposed <br />to the extension of this street between Clement Street and Upper <br />Colonial Drive. They alleged that it would be improper to construct <br />this streeu .:Ir y;, a portion of the wetlands area. However, the public <br />need for means of access to the park, and between one neighborhood and <br />the other, in our opinion, overrides this private viewpoint. <br />r <br />3. We suggest, therefore, that there should be no vacation of any streets <br />unless successful negotiations are accomplished for the ultimate provision <br />of the right-of-way and construction of the street between Clement and <br />Upper Colonial Drive. <br />4. you will also notice on the map a dotted line indicating the location <br />for a pedestrian access to be constructed from Fourth Avenue to the <br />northeast corner of the park. Physical inspection of this site indicates <br />that this would be possible to construct such a pathway now. This, of <br />course, would be on a portion of the existing Clement street right-of-way <br />
