This property was originally two 90 foot lots and was combined by the <br />owner Alfred and Ruth Nellessen to a single parcel with 180 feet of <br />frontage on South Owasso Boulevard. The applicant (Mr. Johnson) <br />proposes to purchase the northeasterly 85 feet of the existing parcel <br />and construct a new single-family residence on the new site. <br />2. Thus, the applicant is proposing a land division creating two lots, one <br />with 95 feet of frontage (for the existing house) and one with 85 feet <br />of frontage for the new house. The lot depths and the lot areas far <br />exceed the minimums. <br />3. With respect to the lot division, an additional 10 feet of right-of-way <br />easement is recommended by the staff and agreed to by the owner. <br />You will note from a copy of the section map of this portion of the <br />City, that the right-of-way to the southwest from this property is 50 <br />feet in width. The right-of-way for South Owasso Boulevard fronting on <br />the subject property and continuing to the northeast is 40 feet in width. <br />The 50 foot right-of-way width is considered adequate because the land <br />to the southeast is railroad right-of-way. Thus, with frontage on only <br />one side, this roadway is considered a "marginal access street" <br />(sometimes referred to as a service road). There is no immediate plan <br />to widen the street or expand the right-of-way at the 40 foot wide <br />section. Based on Council policy, however, it is appropriate that as <br />properties divide or other development approvals are requested in this <br />area, that there be an additional allocation of 10 feet of right-of-way. <br />In this case, allocating this right-of-way as an easement rather than <br />dedication leaves the front yard setback line intact. <br />4. The applicant is also applying for approval of a shoreline ordinance <br />review. Attached is a copy of the plan for the location of a proposed <br />single-family residence. The residence, as you will note, is proposed to <br />be setback 37 feet from the existing right-of-way of Owasso Boulevard. <br />This conforms to the 40 foot setback required in this case, because the <br />existing home to the southwest is setback substantially more. The <br />Roseville ordinance provides that an attached garage to the home can <br />
