REQUEST FOR COUNCIL ACTION DATE: 11/24/86 <br />ITEM NO.: 'd- ';?, <br />Department Approval: Manager Reviewed: Agenda Section: <br />7- HEARINGS <br />Item Description: Carmen Dorso request for Special Use Permit at 2814 <br />North Cleveland Avenue, <br />On October 13, 1986, and again on November 10, 1986, the Roseville Council <br />continued consideration of a request by Carmen Dorso for a Special Use Permit <br />at 2814 N. Cleveland Avenue. This continuation was for the purpose of <br />providing more time for the developer to work with the staff to find potential <br />solutions for the existing storage of bumpers on the northwest portion of the <br />site. <br />Unfortunately, although several contacts and discussions were held with Mr. Dorso <br />and various approaches explored, there does not appear to be any new approaches <br />which are viable and would resolve the situation. The staff ,continues to hold <br />the opinion that the storage of such bumpers is not a legal use of the land and <br />that their removal should take place. (See attched letter from city attorney.) <br />If the council oonours in this position, then the primary question would be <br />whether the applicant would agree to remove the bumpers in a specified time or <br />whether the attorney should be authorized to begin the necessary legal proceedings <br />to have this take place. <br />The situation is, therefore, back to where it was when first considered by the <br />council on October 13, 1986. At that time the status was as follows: <br />The Roseville Planning Commission at its October 1, 1986, meeting <br />unanimously recommended denial of Carmen Dorso's request for Special Use <br />Permit at 2814 North Cleveland Avenue. The denial was based on the <br />following findings of Fact. <br />1. The use is not a legal nonconforming use, because Keystone's bumpers <br />were not stored on the site until 1977. Also, when the zoning <br />district was formed in 1999, bumpers were not stored on the site. <br />2. The illegal use has deleterious impact on the adjacent neighborhood <br />and the future development in the area. <br />RECOMMENDED COUNCIL ACTION: <br />Motion approving/denying Carmen Dorso's request for Special Use Permit at <br />2814 North Cleveland Avenue, based on the aforementioned findings of fact. <br />
