MEMORANDUM <br />Community Development Dept. 490-2236 <br />Date: September 7, 1995 <br />To: Dennis Welsch <br />From: Mike Falk <br />Subject: Northwestern College Physical Education Center <br />In late July, 1995, Northwestern College applied for a building permit for the physical education <br />center that was approved as a part of a planned unit development in March 1986. That permit <br />was issued in early August and construction has begun. As of this W. ng, site grading and <br />footing and foundation work are underway and should be completed in the very near future. <br />Earlier this summer, the college applied for and received a permit for the construction of a 112 <br />stall parking lot to serve the athletic area. Construction on the parking lot is nearing completion. <br />As the construction of the physical education center started, Mr. Tim Kailahan, a neighbor on <br />Little Johanna Lake contacted our department to express concerns he had about the project. <br />Specifically, Mr. Kallahan's concerns included the following: <br />1. Pointing out that the 1986 approval of Northwestern College planned unit development <br />included a condition that the health and fitness building height and massing be approved by <br />the City Council prior to construction. <br />2. That Northwestern College had not worked in good faith with the Rice Creek Watershed <br />District on conditions for a 1992 permit including correcting erosion conditions along the <br />bank of Little Johanna and providing a skimmer to a sediment pond. <br />3. That the size of the building under construction was much bigger than the plan presented <br />in 1986. <br />4. That the first floor elevation of the building under construction was higher than the first <br />floor elevation proposed in 1986. <br />5. That the building setback to the high water mark of the lake and to the edge of the slope <br />might violate the City's Shoreland Management Ordinance requirements. <br />Mr. Kallahan was in to visit with both you and I and was promised a follow up response to the <br />concerns he raised. By reviewing the 1986 City Council minutes, reading through the original <br />planning file for Northwestern College planned unit development, speaking to the original <br />architect on the project, and being in touch with the Rice Creek Water Management District, I can <br />relate the following: <br />1. The 1986 City Council approval of the Northwestern College special use permit and <br />parking variance was approved with the condition that the health and fitness height and <br />massing be approved by the City Council prior to construction. It was the architect's <br />recollection that when the special use permit for the planned unit development was <br />extended in 1991, the Council saw new plans for the health center showing reduced <br />building size. <br />
