May 16, 1989 <br />To: Steve North <br />Acting City Manager <br />From: Craig Waldron ` <br />Director of Planning and Development <br />Ed Burrell �J <br />Finance Director <br />Re: Request from Lido's for additional Tax Relief <br />Attached is a letter from John Labalestra regarding the amount of <br />property taxes Lido's Restaurant is being required to pay in <br />1989. <br />The essence of the letter is a request for some relief by the <br />City. As you will note, they do indicate their taxes have gone <br />up much more than expected and as a result has put additional <br />cost pressure on their business. <br />We have reviewed that request, which we feel, does have a great <br />deal of policy implication. <br />Their concern points out that they believe their valuation <br />is much too high. They could appeal that valuation to the County <br />to assure their property is correctly appraised. <br />. The assessment was for improvements to directly benefit <br />Lido's. The City could adjust that assessment by paying part <br />from the taxes of others in the Community. However, the Council <br />could be setting a precedent which could result in others making <br />the same request or having other taxpayers protest legally the <br />tax relief for only one property owner. We should note that <br />others are affected by the same assessment project as well. <br />We have attached a copy of a news article which does point up the <br />state wide concern about business taxes. It does reinforce the <br />point that nearly all such tax classifications are similarly <br />affected and any decisions to grant relief must be done in the <br />full context of the problem.. <br />We are not making a specific recommendation at this time but do <br />feel there needs to be some discussion regarding these as well as <br />other potential implications before we prepare a recommendation <br />to the Council. <br />We would be most willing to discuss this issue with you and or <br />the Council at forthcoming work session, if that is deemed appro- <br />priate. <br />
