The property in question is the Mother Tucker's Restaurant site located <br />northeasterly of the service road, contiguous to the interchange of Trunk <br />Highway 36 and I-35W. This site development as you will recall, is zoned <br />B-lB, and was approved for a special use permit for site plan approval <br />several months ago. The restaurant is now substantially complete and open <br />on a limited basis. <br />You will recall that this site was initially purchased by the Mother <br />Tucker people about three years ago and then was expanded to include an <br />area of land formerly owned by Long Cadillac. The restaurant is one of <br />the larger restaurants in Roseville, and is a Class I full service <br />facility. <br />2. Being zoned B-lB, the site is allowed a pylon sign of 100 square feet if <br />located contiguous to a freeway, with a height of 25 feet. Wherever a <br />site is contiguous to a frontage road, contiguous to a freeway (or an <br />interchange of a freeway), it is considered fronting on a freeway. If the <br />site were zoned B-2 or B-3, contiguous to a freeway, the sign could be 225 <br />square feet with a height of 45 feet. <br />The reason the pylon sign square footage area was restricted to 100 square <br />feet in the B-lB District versus 225 square feet in the B-2 or B-3 <br />District is that the B-1B District was originally designed to primarily <br />apply to the land across the highway from the residences on the old Gluek <br />Farm No. 2 property, west of Fairview, north of Highway 36. The B-1B <br />District also included provisions for site plan approval, and required <br />three percent of the parking area to be landscaped. This was done <br />primarily to offer protection to the residences across the highway to the <br />south (Gluek Lane and others). <br />3. When inquiring about allowable sign size, the applicants were under the <br />impression that the 225 square foot and 45 foot height criteria would <br />apply to their site. The Building Inspector informs us that this <br />misunderstanding did in fact occur. Therefore, they ordered a pylon sign <br />which has approximately 167 square feet and a height of 40 feet. The sign <br />was on site at the time this discrepancy was discovered and the Building <br />Inspector allowed them to construct it, with the understanding that if a <br />variance is not approved, that it would have to be removed. <br />
