A newSection 4.9 is hereby added to the City <br />C" ` S <br />ode to read as follows: - T' <br />Sec- 1.9, PLACES INELIGIBLE. <br />(a) No license nor any special use permit required by <br />this Chapter r'►ali De granted to premises with a <br />Property line within 40 feel of itla property Ilse of any <br />Council, at Ittssso <br />Public or Solparochial school or church In the City. The <br />e discretion, may allow a lesser ' <br />distance upon making a finding that the location of Said <br />11Cense is not unduly detrimental to the public health, <br />welfare and safety Of the citizens of New Brighton. The <br />Council, at its sole discretion, may require a greater <br />• distance upon making a finding that the location of <br />license is unduly detrimental said <br />to Me public health, <br />welfare and safety of the citizens of New Brighton. Such <br />findings shall be made by the Council alter considering <br />the effect of natural barriers, highway fh0roughleres, a Proximity to park, areas and other areas of •�: <br />sue -MY, the acAvill" conducted in any such churIch ' ar school, the nature of the licensed operation and the <br />orientation of and access to the building and property. . <br />Setflon 2.
