PLANNING REPORT 0 <br />DATE: 6 June 1984 <br />CASE NUMBER: 1495-84 <br />APPLICANT: Kelly McGurran <br />LOCATION: West of Marion Street, Fourth Lot South of County <br />Road C-2 (2849 Marion Street) <br />ACTION REQUESTED: Approval of Side Yard Variance <br />PLANNING CONSIDERATIONS: <br />1. Normally, approval of a side yard variance for a single family dwelling as <br />proposed by this applicant is handled under the "Minor Variance" procedure <br />in the City of Roseville. This procedure requires a written approval of <br />the effected property owners, unanimous consent of the three ;person Minor <br />Variance Board (three appointed City officials), and final approval of the <br />City Council. Since this procedure was inaugurated, it has been capable <br />of handling all minor variance proposals involving single family <br />residences except two (one of which is this application). <br />2.' In the case of a side yard variance as is proposed here, one of the <br />obviously affected property r-mers is the contiguous neighbor. In this <br />case, that owner, at 2841 Marion, has refused to consent to the proposed <br />variance. The applicant in this case, has a 13 foot, 5 inch wide attached <br />garage. He proposes to expand it 7 feet, 7 inches in width to produce a <br />21 foot garage. This results in the garage being 8 feet, 3 inches from <br />the side property line, whereas in this part of the City, 1Q feet is <br />required. Thus, the variance is 1 foot, 9 inches. Ironically, most <br />variances applied for involve intrusions into the side yard to a greater <br />extent than that proposed here. <br />The applicant has determined that in order to provide a double garage, an <br />absolute minimum of 21 feet is required. Most double garages, if there is <br />adequate room are constructed 24 feet wide. Many double garages are at 22 <br />feet. The hardship here is that the house exists in its present location <br />and in order to provide for an adequate double garage that works, 21 feet <br />is a reasonable need. <br />3. In many parts of the City, where the land was platted prior to March of <br />1959, the required side yard setback is 5 feet. This policy has been <br />followed in the City of Roseville since 1959 inasmuch as prior to that <br />date, the required side yard setback (required side yard) 4as 5 feet. <br />4. Attached is a statement from the applicant and copies of drawings he has <br />submitted. You will note that the applicant mentioned that the overhang <br />can be 3 feet from the property line. This is not quite correct. <br />Inasmuch as Roseville Ordinances allow an overhang to exist beyond the <br />required setback line a maximum of three feet. Thus, with a 10 foot <br />setback required, an overhang can be within 7 feet of the side lot line. <br />
