Westerlund <br />LOCATION: Northwest Corner of Lexington and Sandhurst <br />ACTION REQUESTED: Approval of Variance to Parking Setback <br />Approval of Variance to Sidewalk Requirements <br />PLANNING CONSIDERATIONS: <br />1. The variances relating to this site plan were approved by the Planning <br />Commission and Council about a year ago. The applicant proposes to construct, <br />as you may recall, an office building with pitched roofs, substantially <br />residential in character. The plan was approved with a ten foot setback <br />on the north property line, in concurrence with the owner of the contiguous <br />property to the north. Because that is the rear of the lot, a 20 foot <br />setback is required in a business district (the property is zoned B-1). <br />A variance to the sign setback was also approved contiguous to Lexington <br />Avenue. The parking layout south of the building was approved with 15 <br />foot setbacks as required contiguous to the public right-of-way, but was a <br />protrusion toward Lexington Avenue within seven feet so as to provide for <br />the cars parked on the east side of the lot to back out. <br />2. Several months ago the applicant came to members of the City staff and <br />pointed out that their survey from which they had prepared the original <br />site plan proved to be incorrect with respect to the location of some of <br />the key large trees on the site. Two of these trees are on the north side <br />of the property which can be saved if the building is moved five feet <br />further south so as to be 15 feet from the north property line. To accomplish <br />this and retain the required parking ratio, the parking lot then moves five <br />feet closer to Sandhurst Drive, making that setback ten feet rather than the <br />required 15 feet. There is another tree near the southeast corner of the <br />site which can be saved by eliminating two parking spaces on the east side <br />of the lot and replacing them with thret&,. spaces facing toward Lexington. <br />This setback would remain at seven feet as previously approved, but would <br />now be occupied by three parking spaces rather than a back -around area. <br />3. Inasmuch as the staff is not authorized to make such drastic changes in <br />setback requirements, we suggested the applicant file for a revised <br />variance request. Thus, the current request is to reduce the variance on <br />the north side by five feet from what was previously approved, making the <br />setback 15 feet (20 feet is required). <br />On the south a variance is requested to a ten foot setback for the parking <br />north of Sandhurst Drive.
