Benches shall be inspected <br />83 weekly for any damaged or broken parts and shall repair or replace damaged or broken <br />84 parts within 48 hours after damage or breakage is discovered or reported. <br />85 <br />86 N.Liability Insurance: A certificate of liability insurance shall be filed with the city covering <br />87 claims for damages which might arise out of the use or placement of a bench in the public <br />88 right of way naming the city as an additional insured. The minimum limit of liability shall <br />89 be six hundred thousand one million dollars ($61,000,000.00). <br />90 <br />91 O. Revocation of License: The city may suspend or revoke any license under this Chapter <br />92 pursuant to Section 301.09 of the Roseville City Code. <br />93 <br />94 P. Removal: At the request of the Public Works Director, a bench shall be removed at the <br />95 permitteelicensee’ssole expense in order to permit right-of-way improvements or <br />96 maintenance. If the location of the bench is a safety hazard or if it interferes with pedestrian <br />97 or vehicular traffic on the right of way, or if the bus route changes, the provider licensee <br />98 must removal remove the courtesy bench within 30 days of the route change. A bench shall <br />99 also be removed thirty (30) days following expiration of the license <br />100 <br />101 Q. State or County Permission: If the bench placement is in a Minnesota Department of <br />102 Transportation or county right of way, written permission must be secured from the <br />103 Minnesota department of transportation or the county and filed with the city. Applicants and permittees licensees must meet all local, state, and federal requirements <br />107 applicable to bus courtesy benches, their placement, and their use for public transit <br />108 services. (Ord. 1294, 9-15-2003) <br />109 <br />110 SECTION 2: Effective date.
