44 due solely to the fact that the then-total number of premises permits issued <br />45 by the city has declined causing that organization exceed the Fifty Percent <br />46 Threshold. <br />47 <br />48 B C.The maximum number of premises permits issued by the city pursuant to <br />49 Minnesota Statutes Chapter 349 shall be is twelve. Gambling activities shall <br />50 be confined to the types defined and regulated under Minnesota Statutes <br />51 Chapter 349. <br />52 <br />53 CD.An organization in existence and qualified under section 501(c)7 or section <br />54 501(c)19 of the internal revenue code and which had its principal place of <br />55 business or place of conducting meetings in the city prior to and continuing <br />56 since 1980 may be granted a premises permit to conduct all lawful gambling <br />57 operations on their own premises. <br />58 <br />59 304.03: APPROVAL OF LICENSES PREMISES PERMITS: <br />60 <br />61 A.Required Documentation: Any organization applying to the Gambling <br />62 Control Board for a premises permit or for the renewal of the same to conduct <br />63 lawful gambling in the city shall, within ten days of making such application, <br />64 file with the City Manager, or their designee, an executed copy of all <br />65 application materials submitted to the Board State. <br />66 <br />67 B.Investigation: Upon receipt of the materials required by subsection A of this <br />68 section, City staff shall investigate the applicant and based upon said <br />69 investigation, the City Council shall act on the application. Applications for <br />70 premises permits will be reviewed by the City Manager, or their designee, <br />71 and may be subject to review by the Police Department or other qualified <br />72 service providers to conduct and complete an investigation which may <br />73 include a criminal background check. The city may conduct a background <br />74 check on any an application for a renewal if it is in the public interest to do <br />75 so. <br />76 <br />77 C.Resolution: Failure to receive a majority affirmative vote of the City Council <br />78 shall constitute a denial of the application. The City Council may either <br />79 approve or deny the application for a premises permit, or it may delay action <br />80 for a reasonable period of time as necessary to complete any investigation of <br />81 the application or the applicant it deems necessary.
