EXTRACT OF MINUTES OF MEETING <br /> OF THE <br /> CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of <br /> Roseville, County of Ramsey, Minnesota was duly held on the 8h day of April 2024, at 6:00 p.m. <br /> The following members were present: Etten, Schroeder, Groff, and Mayor Roe. <br /> and the following were absent: Strahan. <br /> Member Etten introduced the following resolution and moved its adoption: <br /> RESOLUTION No. 12064 <br /> RESOLUTION OF DECISION OF THE BOARD OF ADJUSTMENTS AND APPEALS <br /> CONCERNING THE APPEAL BY AMAROK ULITIMATE PERIMETER SECURITY <br /> AND CALIBER COLLISION OF 1914 COUNTY ROAD C OF THE VARIANCE <br /> BOARD'S DENIAL OF A FENCE VARIANCE <br /> WHEREAS, on October 4, 2024, Amarok Perimeter Security Systems made application <br /> for a variance to Section 1011.08.A.3, Fences In All Districts, on behalf of Caliber Collision, <br /> 1914 County Road to install a 10-foot tall, low voltage, 12V/DC battery powered, pulsed electric <br /> security fence on the interior of the existing screen fence that currently secures vehicles on the <br /> premises; and <br /> WHEREAS, on March 6, 2024, the Roseville Variance Board held the duly noticed <br /> public hearing concerning the requested variances; and <br /> WHEREAS, Section 1009.04 (Variances) of the City Code also explains that the purpose <br /> of a VARIANCE is "to permit adjustment to the zoning regulations where there are practical <br /> difficulties applying to a parcel of land or building that prevent the property from being used to <br /> the extent intended by the zoning." <br /> WHEREAS, The Variance Board determined in a 3-0 vote the requested variance did not <br /> satisfy the requirements essential for approving the requested variance. Specifically, the <br /> Variance Board concluded the applicant did not demonstrate practical difficulties preventing <br /> compliance with the fence regulations of the Zoning Code, specifically that alternative security <br /> measures and/or fence construction methods and designs could be utilized to achieve similar <br /> results. <br /> WHEREAS, On March 15, 2024, Amarok filed an appeal to the decision of the Variance <br /> Board; and <br /> WHEREAS, a public meeting date was scheduled for April 8, 2024, consistent with the <br /> requirements under Section 1009.08.B.3; and <br /> WHEREAS, on April 8, 2024, a public meeting was held by the City Council, acting as <br /> the Board of Adjustment and Appeals to hear the appeal and issue a decision. <br />
