REQUEST FOR COUNCIL ACTION
Date: 6/3/2024
Item No.: 7.b.
Department Approval City Manager Approval

Item Description: Public Hearing and Consider Resolutions Approving the Vacation of
Multiple Streets Easements and Rights-of-Way

Background
Over the past several years, staff has identified rights-of-way that the City no longer needs
for public benefit. Some of these rights-of-way were dedicated to the City for future
roadways that were never constructed, some were partial right-of-way dedications, while
others were alley dedications. In all cases, the City has no plans to construct a future
roadway.

By vacating these rights-of-way, the area will revert to the underlying property owners. The
owners will benefit from having more control over the former right-of-way areas. This also
helps with confusion and disagreements over how the right-of-way area should be
maintained in regard to vegetation control and debris management.

Some of the corridors have utilities or trails within the right-of-way. However, since a
roadway will not be constructed, an easement would be more appropriate for the identified
vacation area. Where it is appropriate, the proposed resolution will reserve utility easement
rights in the vacated areas.

On April 11, 2022, Council authorized staff to begin the vacation process for these
locations. Staff have brought two phases of vacations previously, and these two vacation
areas are part of Phase 3.

Vacation D was presented at the June 5, 2023 Council meeting, but was not acted on since
there was feedback from residents on the vacation area. The area for this has been
modified to retain trail access into the Ramsey County Park.

Vacation O vacates right-of-way of certain alleys and walks that are dedicated in Tschida’s
Plat and Chas. A.B. Weide’s Midway Addition Plat, an area bounded by County Rd. B2,
Grotto St., Cope Ave., and Victoria Street.

Additional public hearings are anticipated later this summer for more complex vacation
areas.
Qbhf!35!pg!357
