<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 7/8/2024 <br />Item No.: 10.c. <br />Department Approval City Manager Approval <br /> <br />Item Description: Approve the renewal of a short-term rental license for 257 South McCarrons <br />Blvd W <br />1 <br />2 Background <br />3 Chapter 909 of the City Code requires the licensing of non-owner-occupied short-term rentals of dwelling <br />4 units, subject to certain exemptions. The original short-term rental license for 257 South McCarrons <br />5 Boulevard West was issued on July 13, 2021, and this owner has obtained a license each year since. On <br />6 May 19, 2024, an application for renewal of the short-term rental license was submitted by the property <br />7 owner. The property is a five-bedroom, single family home. The property owner has certified and attested <br />8 to the requirement of lodging tax payment, as well as the maximum occupancy of four or less unrelated <br />9 adults or one family. The subject property’s current short-term rental license is valid through July 14, 2024. <br />10 There have been no confirmed nuisance or property maintenance violations. There have been no <br />11 payments of lodging tax, although the property owner informed staff there have been no rentals requiring <br />12 lodging tax payments. Short-term rental licenses include the requirement of minimum stays based on on- <br />13 season (10 days) and off-season (7 days) times of the year. <br />14 Upon renewal, the license will be valid for 365 days from the expiration date of the current license. A <br />15 current copy of the license must be posted in the rental unit, along with current copies of City Code <br />16 Sections 405, 407 and 602. Within ten days of Council approval, all residential properties of one to four <br />17 units within 300 feet must be provided with a copy of the City-issued license. A draft of the license is <br />18 provided as Attachment 2. <br />19 The applicant has supplied all required license information and paid the license fee of $515. In accordance <br />20 with Section 909.03, the process for licensure is outlined in Chapter 301, which requires presentation to <br />21 the City Council. Based upon the requirements outlined in the ordinance, the property owner is entitled to <br />22 a license renewal. <br />23 <br />24 It is also important to note that residents have requested the current short-term rental license be revoked <br />25 because of the fence that was recently erected in the City right-of-way located in front of the property. <br />26 This fence is not permitted, which is why residents have requested revocation of the short-term rental <br />27 license. This issue has been discussed with the City Attorney, who has advised that 1) the illegally <br />28 erected fence cannot be included as a violation given a permit was issued by the City for the fence <br />29(albeit in error) and 2) there are no other confirmed violations related to rentals and City Code requires <br />30 two confirmed violations before suspension, revocation and/or non-renewal could be considered. <br />31 <br />32 Policy Objectives <br />33 Licensing is required by Section 909, effective as of February 8, 2021. <br />34 <br />35 <br />36 Racial Equity Impact Summary <br />37 Staff have not identified any racial equity impacts related to this action. <br />Page 1 of 2 <br />Qbhf!54!pg!88 <br /> <br />
