<br />REQUEST FOR COUNCIL ACTION <br />Date: 8/19/2024 <br />Item No.: 7.b. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Authorize Staff to Begin Vacation Process for Excess Right-of-Way <br />for South McCarrons Boulevard <br />1 <br />2 Background <br />3 Since April 11, 2022, staff has worked with Council to vacate excess rights-of-way or <br />4 easements in over 20 locations as the City no longer needs for a variety of reasons. Some <br />5 of these rights-of-way were dedicated to the City for future roadways that were never <br />6 constructed. Some were partial right-of-way dedications while others were alley <br />7 dedications. In all the cases, the City has no plans to construct a future roadway. Some of <br />8 the corridors have utilities or trails within the right-of-way but some sort of easement, which <br />9 would be more appropriate if a roadway will not be constructed, would be maintained if the <br />10 right-of-way was vacated. <br />11 <br />12 By vacating these rights-of-way, the City will be able to provide the proper maintenance of <br />13 the corridors and adjacent property owners, in most cases, will have the benefit of having <br />14 more control of the former right-of-way. This also helps with confusion and disagreements <br />15 over how the right-of-way area should be maintained in regards to vegetation control and <br />16 debris management as well as used by adjacent property owners. <br />17 <br />18 One location that was not included in the original request to vacate was South McCarrons <br />19 Boulevard between Roselawn Avenue and Galtier Street as shown on Attachment 1. This <br />20 right-of-way corridor is unique and has right-of-way that varies, but in some locations is 99 <br />21 feet wide. The right-of-way was dedicated partially in a plat as well as being turned back <br />22 County Right-of-Way, since South McCarrons was originally a county road. The excess <br />23 right-of-way has no public purpose and has caused confusion to adjacent property owners <br />24 due to the deep boulevards. <br />25 <br />26 Recently, in 2021, when the Enclave development and plat was approved, the City vacated <br />27 a portion of the south side of South McCarrons Boulevard right-of-way, east of Galtier <br />28 Street. When the City vacated some of the excess right-of-way, 33 feet of right-of-way was <br />29 retained to the center of the roadway. Staff is recommending the excess right-of-way on the <br />30 north side of South McCarrons Boulevard between Roselawn Avenue and Galtier Street be <br />31 vacated similarly. This will vacate all excess right-of-way approximately 6 feet north of the <br />32 existing pathway.
