ATTACHMENT 3 <br />184 A. Special Services Fee Deposit. If any Special Services are to be used during the <br />185 Temporary Cannabis Event, the applicant may be required to pay a Special Services <br />186 fee deposit at least ten business days before the Temporary Cannabis Event. The City <br />187 Manager shall determine the Special Services fee deposit. It shall be based upon an <br />188 estimate of Special Services that are necessary as determined by the City’s <br />189 department heads. <br />190 <br />191 B.User Fee. Upon completion of the Temporary Cannabis Event, the City may prepare a <br />192 detailed account of all Special Services provided for the Temporary Cannabis Event <br />193 and in such cases, will set the final user fee using the rates, fees and charges <br />194 established as provided in this ordinance. The City will then provide the applicant <br />195 with a copy of the detailed account of the Special Services and an invoice for the user <br />196 fee, less the fee deposit. The balance of the user fee will then become due and payable <br />197 immediately upon its receipt. <br />198 <br />199 C.Special Services Rates. The rates charged shall be set by the City’s fee ordinance. <br />200 <br />201 \[Rather than B and C, the city could charge actual costs.\] <br />202 <br />203 318.07 INDEMNIFICATION AND INSURANCE. <br />204 <br />205 A. If the Temporary Cannabis Event requires Special Services, or is to be held on city <br />206 property, prior to the issuance of a Temporary Cannabis Event permit, the permit <br />207 applicant and authorizing officer of the sponsoring organization, if any, must sign an <br />208 agreement to indemnify, defend and hold the City, its officials, employees, and agents <br />209 harmless from any claim that arises in whole or in part out of the Temporary <br />210 Cannabis Event, except any claims arising solely out of the negligent acts or <br />211 omissions of the City, its officials, employees and agents. <br />212 <br />213 B.Liability Insurance Required. The applicant must possess or obtain liability insurance <br />214 to protect against loss from liability imposed by law for damages on account of bodily <br />215 injury or property damage arising from the Temporary Cannabis Event. A certificate <br />216 of insurance must be filed with the City prior to issuance of the Temporary Cannabis <br />217 Event permit. The certificate of insurance must name the City, its officials, employees <br />218 and agents as additional insureds. Insurance coverage must be maintained for the <br />219 duration of the Temporary Cannabis Event. Any company hired or working on behalf <br />220 of the applicant or sponsor must also present the Citywith a certificate of insurance <br />221 naming the City, its officials, its employees, and agents as additional insureds. <br />222 <br />223 C.Minimum Limits. Insurance coverage must be a commercial general liability policy. <br />224 The minimum limits must be at least $1,000,000. If on-site consumption is permitted <br />225 at the Temporary Cannabis Event, the policy must also include an endorsement for <br />226 such consumption.
