ATTACHMENT 2 <br />44 businesses within the City. The City finds and concludes that these regulations are <br />45 appropriate and lawful, that the proposed amendments will promote the community's <br />46 interest in reasonable stability in the development and redevelopment of the City for now <br />47 and in the future, and that the regulations are in the public interest and for the public <br />48 good. <br />49 <br />50 318.02 DEFINITIONS. <br />51 <br />52 The following words, terms, and phrases, when used in this Chapter, shall have the <br />53 meanings ascribed to them in this Chapter, except where the context clearly indicates a <br />54 different meaning: <br />55 <br />56 APPLICANT means an entity with a license issued by the OCM that is applying for an <br />57 initial registration or for registration renewal. <br />58 <br />59 THE ACT means Minnesota Statutes, Chapter 342, as is may be amended from time to <br />60 time. <br />61 <br />62 CANNABIS BUSINESS shall have the definition in Minnesota Statutes Section 342.01. <br />63 <br />64 CANNABIS RETAILER means every retail cannabis business that is licensed under the <br />65 Act and required to register with the City under Minnesota Statutes, section 342.22. <br />66 <br />67 HEMP BUSINESS shall have the definition in Minnesota Statutes Section 342.01. <br />68 <br />69 LOWER-POTENCY HEMP RETAILER means every lower-potency hemp edible retail <br />70 business that is licensed under the Act and required to registerwith the City under <br />71 Minnesota Statutes, section 342.22. <br />72 <br />73 MEDICAL CANNABIS COMBINATION BUSINESS shall have the definition in <br />74 Minnesota Statutes Section 342.01. <br />75 <br />76 OCM means the Office of Cannabis Management. <br />77 <br />78 POTENTIAL LICENSEEmeans an applicant that has not received a license from the <br />79 OCM. <br />80 <br />81 318.03 PRE-LICENSE CERTIFICATION OF CANNABIS BUSINESSES. <br />82 <br />83 A. The City Manager, or their designee, is authorized to certify whether a proposed <br />84 Cannabis Business complies with the City’s zoning ordinances and, if applicable, <br />85 with state fire code and building code, pursuant to Minnesota Statutes, section <br />86 342.13. <br />87 <br />88 B.Potential licensees are responsible for making all necessary zoning applications <br />89 prior to the City receiving the request for certification from the OCM.
