<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 11/4/2024 <br />Item No.: 7.b. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Review the proposed 2025 Fee and Administrative Penalty Schedules <br />1 <br />2 Background <br />3 Each year the City Council is asked to adopt a Fee Schedule which establishes the fees and charges for <br />4 service for the City’s regulatory functions. The presence of a fee schedule allows regulatory-type fees to <br />5 be easily identified in one document, as opposed to being scattered throughout City Code. In addition, a <br />6 fee schedule adopted on an annual basis provides the Council the opportunity to review fees for <br />7 services in a comprehensive manner. <br />8 <br />9 Over the past several months, Staff has reviewed the direct and indirect costs of these regulatory <br />10 functions to determine whether fee adjustments are necessary or if new fees should be established. <br />11 Additionally, as staff is currently in the middle of a recodification process, there was an opportunity to <br />12 review the entire city code to ensure all fees were included in the fee schedule and that penalties within <br />13 the city code were also captured in a separate document. With this comprehensive review of the city <br />14 code, Council will see a new format for the fee schedule along with additional fees listed. Unless noted, <br />15 these are not new fees, but rather fees that were being collected but may not have been listed on the fee <br />16 schedule. <br />17 <br />18 All the proposed changes are highlighted on the attached Fee Schedule (Attachment 1), and reflect the <br />19 need to recover increased regulatory costs, staff time related to special requests, or development- <br />20 related impacts on city services. This fee schedule includes several sections: General Business <br />21 Licenses and Permits, Permit and Plan/Project review fees, Community Development Miscellaneous <br />22 fees, and Electrical Permit fees. There is also a new section that lists all the penalties that are defined <br />23 throughout city code. This Administrative Penalty schedule does not have any new penalties proposed, <br />24 but rather consolidates all penalties into one document as part of the fee schedule. <br />25 <br />26 Attachment 1 shows the 2024 amounts and the proposed 2025 amounts. At this time council is being <br />27 asked to review the document. Staff will bring back an ordinance at the December 2 meeting to formally <br />28 adopt the schedules. <br />29 <br />30 Below is a summary of changes: <br />31 <br />32 Administrative Penalties <br />33 There are no new penalties proposed. <br />34 Lines 1-2 were previously in city code but not captured in the previous schedule. <br />35 Line 3: There is an increase from $100 to $105 proposed for a City Code Violation (General) for <br />36 increased staff costs. <br />37 Lines 5-59: These penalties were listed in Chapter 3 related to alcohol but were not fully <br />38 incorporated into the previous schedule. <br />39 Lines 72-74: These penalties were listed in Chapter 8 but were not fully incorporated into the <br />40 previous schedule.
