<br />ATTACHMENT 3 <br />93 318.03, and, if applicable, with state fire code and building code. Pre-license <br />94 certification does not indicate whether the limit on the number of retail <br />95 registrations has been reached guarantee approval of a future application for <br />96 registration under this chapter. <br />97 <br />98 B.Potential licensees are responsible for making all necessary zoning applications <br />99 prior to the City receiving the request for certification from the OCM. If a <br />100 potential licensee fails to obtain necessary zoning approvals prior to the City <br />101 receiving a request for certification, the City will inform the OCM that the <br />102 potential licensee does not meet zoning and land use laws. If, at the time the City <br />103 receives a request for zoning certification, there are no further intended alterations <br />104 to the building where the business is to be conducted, the City will also certify <br />105 compliance with building and fire code regulations, provided that the potential <br />106 licensee has obtained inspections prior the City’s receipt of a request for <br />107 certification from the OCM. Building and fire code inspections will be valid for 1 <br />108 year from completion. <br />109 <br />110 C.No Cannabis Business may be located within 100 feet of a school or daycare, or <br />111 within 500 feet of a residential treatment facility. <br />112 <br />113 318.04REGISTRATION OF RETAILERS. <br />114 <br />115 Retail Registration Required. Before making retail sales to customers or patients, all <br />116 Cannabis Retailers and Lower-Potency Hemp Retailers must register with the City. <br />117 Making retail sales to customers or patients without an active registration is prohibited. <br />118 <br />119 318.05CANNABIS RETAILER REGISTRATION LIMITS. <br />120 <br />121 A.Limit on number of Cannabis Retailer registrations: <br />122 <br />123 1.The City will issue one registration per 12,500 residents in the City. <br />124 <br />125 2.The number of registrations available will be calculated by dividing the <br />126 state demographer’s estimate of the City’s population by 12,500 and <br />127 rounding up to the nearest whole number. <br />128 <br />129 3.The City will update the number of registrations available based on the <br />130 most recent data available from the state demographer on January 1 and <br />131 June 1 each year. <br />132 <br />133 4.If the number of registrations available in the City decreases for any <br />134 reason, businesses with current registrations will be allowed to maintain <br />135 and renew their registrations, but no new registration will be issued. <br />136 <br />137 5.Registrations issued to businesses with a license preapproval will count <br />138 toward the City’s registration limit. <br />RS160\\1\\975348.v7 <br />Qbhf!212!pg!745 <br /> <br />
