<br />ATTACHMENT 4 <br />229 E.Right of Appeal. If the Temporary Cannabis Event permit application has been <br />230 denied, the applicant may appeal the decision to the City Council. The applicant must <br />231 provide the City Manager with written notice of appeal within five business days of <br />232 the date of denial. <br />233 <br />234 319.06FEES FOR SPECIAL SERVICES. <br />235 <br />236 A.Special Services Fee Deposit. The applicant must pay the costs of all If any Special <br />237 Services are to be used during the Temporary Cannabis Event. Such costs will be <br />238 established in the City’s fee schedule. At the discretion of the City Manager, , the <br />239 applicant may be required to pay a Special Services fee deposit based on the <br />240 estimated costs of the Special Services to be provided at the Temporary Cannabis <br />241 Event. Such deposit must be paid at least ten business days before the Temporary <br />242 Cannabis Event. The City Manager shall determine the Special Services fee deposit. <br />243 It shall be based upon an estimate of Special Services that are necessary as <br />244 determined by the City’s department heads.If no deposit has been made, or in the <br />245 event that the costs exceed the deposit, the balance owed must be paid within thirty <br />246(30) days. <br />247 <br />248 \[Note: Special event policy: “A cash deposit may be required before the special <br />249 event occurs based on the anticipated and potential cost to the city.”\] <br />250 <br />251 B.User Fee. Upon completion of the Temporary Cannabis Event, the City may prepare a <br />252 detailed account of all Special Services provided for the Temporary Cannabis Event <br />253 and in such cases, will set the final user fee using the rates, fees and charges <br />254 established as provided in this ordinance. The City will then provide the applicant <br />255 with a copy of the detailed account of the Special Services and an invoice for the user <br />256 fee, less the fee deposit. The balance of the user fee will then become due and payable <br />257 immediately upon its receipt. <br />258 <br />259 C.Special Services Rates. The rates charged shall be set by the City’s fee ordinance. <br />260 <br />261\[Rather than B and C, the city could charge actual costs.\] <br />262 <br />263 319.07 INDEMNIFICATION AND INSURANCE. <br />264 <br />265 A.If the Temporary Cannabis Event requires Special Services, or is to be held on city <br />266 property, prior to the issuance of a Temporary Cannabis Event permit, the permit <br />267 applicant and authorizing officer of the sponsoring organization, if any, must sign an <br />268 agreement to indemnify, defend and hold the City, its officials, employees, and agents <br />269 harmless from any claim that arises in whole or in part out of the Temporary <br />270 Cannabis Event, except any claims arising solely out of the negligent acts or <br />271 omissions of the City, its officials, employees and agents. <br />272 <br />273 B.Liability Insurance Required.
