<br />REQUEST FOR COUNCIL ACTION <br />Date: 11/25/2024 <br />Item No.: 7.c. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Certify Unpaid Invoice for Water Repair at 435 Judith Avenue <br />1 <br />2 Background <br />3 On February 22, 2023, the City became aware of a water leak at 435 Judith Avenue. After <br />4 inspection, it was determined that the leak was from a private water service. Since it was <br />5 leaking at the curb stop (shut off valve), the water for this property could not be shut off to <br />6 stop the leak. The only way to resolve the leak was to repair the service or shut off the <br />7 watermain. Shutting off the watermain was not practical as it would have impacted <br />8 numerous other properties. Since the leak occurred during winter months, it caused icing <br />9 conditions on Judith Avenue. Due to the public safety concerns with street icing <br />10(Attachment 5), staff did an emergency water repair and then invoiced the property owner <br />11 for the repair. The invoice of $6,975 has not been paid. <br />12 <br />13 Per City Code 801.12 LEAKS, property owners are responsible for the repair as property <br />14 owners own the water service from the watermain to their home: <br />15 <br />16 801.12: REPAIR OF LEAKS: It shall be the responsibility of the consumer or owner to <br />17 maintain the service pipe from the water main into the house or building. In case of <br />18 failure upon the part of any consumer or owner to repair any leak occurring in such pipe <br />19 within twenty-four (24) hours after verbal or written notice, the water will be shut off and <br />20 will not be turned on until the leak is repaired. When the waste of water is great, or when <br />21 damage is likely to result from the leak, the water may be turned off immediately pending <br />22 repairs. A water shutoff charge shall be made in an amount set by City Council <br />23 resolution. (Ord. 530, 3-20-1967; 1995 Code) (Ord 1590, 10-12-2020) <br />24 <br />25 Communication Dates: <br />26 <br />27 On February 22, 2023, staff notified the property owner in person they needed to make <br />28 the repair due to their leaking water service. <br />29 <br />30 On March 7, 2023, staff sent a letter (Attachment 4) to the property owner to make <br />31 provisions to have the repair done by Wednesday, March 8, 2023. <br />32 <br />Page 1 of 2 <br />Qbhf!54!pg!745 <br /> <br />
